This action prompted a coalition of 16 states—including California, New York, Colorado, and Washington—to file a lawsuit aimed at preserving crucial funding for EV chargers. The states assert that the federal government lacks the authority to withhold these funds.

The suit has gained traction, particularly in light of California Governor Gavin Newsom’s emotional response, where he likened the funding cuts to a “gift to China.” Newsom emphasized that reducing support for EV infrastructure negatively impacts American innovation and job opportunities. The National Electric Vehicle Infrastructure (NEVI) program, initiated through the bipartisan infrastructure law of 2021, was designed to allocate $5 billion to build fast-charging stations across the country.

Future of Electric Vehicle Programs

The implications of this lawsuit extend beyond immediate funding concerns. The NEVI initiative promises to advance the development of a nationwide charging network, essential for increasing EV adoption. As of early February, approximately $2.75 billion in NEVI funds remained unobligated, with only a fraction disbursed to states. The legal challenge represents a significant moment for the future of electric vehicles in the U.S., as it serves as a check against potential overreach by the federal government regarding EV policies.
